Afeef: Aragtida qoraalkan waa mi du gaar ah qoraaga ku saxiixan

Two recent postings on Puntlandpost.com and Somalitalk.com attracted my attention. The first one appeared on Puntlandpost.com on 28 June 2003 and concerned an allegation made by the wife of the late Abdirahman Aideed that her husband was murdered in Dire Dawa, Ethiopia, in 1984 by a man named Mohamed Habib Warsame (Gees-dheer) who currently resides in Britain. Mrs. Amina Ahmed Warsame also claimed to have proof that Mr Habib Warsame killed her husband. She also alleged that Col. Abdullahi Yusuf was behind the murder of her husband. According to Puntlandpost.com, this allegation was published in a leaflet she distributed at the Somali reconciliation conference in Kenya. There is nothing new about the allegation associating Col. Abdullahi Yusuf with the death of Abdirahman Aideed. It has been an article of faith for the political opponents of Col. Abdullahi Yusuf for a long time.

What is new this time, at least to me, is that she named a man she alleged to have killed her husband. This is a significant development that could put the case within a legal framework in the UK. It is not clear to me whether the identification of a suspect after twenty years is based on new evidence or is yet another unsubstantiated rumour, which is being used for propaganda purpose to smear Col. Abdullahi Yusuf..

Amino Warsame made a very serious allegation and should follow it through. If she is interested in justice for her late husband, she should take her evidence to the British police. The British legal authorities are the proper place where she should take her allegations against Mohamed Habib Warsame. However, it seems she wants to use or to assist others to use her husband’s death for political purpose.

I would guess that Amino Warsame and her supporters have explored the option of going to the police with the “new evidence” but came to the conclusion that the British authorities would not take action against either Abdullahi Yusuf or Mohamed Habib Warsame on their words. She knows that she has to produce evidence beyond reasonable doubt for action to be taken. In the eyes of the law, a man is innocent until proven guilty, and Abdullahi Yusuf and Mohamed Habib Warsame are no exception. Amino Warsame and her supporters would do everyone a favour if she follows proper legal procedure and rests her case once and for all in front of a court of law. That is the logical step to take.

If Amina Ahmed Warsame does not follow her serious allegation with legal proceedings against the man she alleges to have murdered her husband, she should realise that Mohamed Habib Warsame might take legal action against her for slander, defamation and character assassination. Slandering someone could have serious consequences. At the very least, the court could give him an injunction that prohibits her and others from repeating her unsubstantiated allegation.

The second item that attracted my attention appeared in Somalitalk.com on June 30, 2003 under the heading: Should a Defendant Run for a National Leadership of Somalia? The “defendant” in question was Col, Abdullahi Yusuf. This was a Press Release by a group called Somali Peace Rally. I don’t know what this group stands for. But like Mrs Amina Warsame they accused Col. Abdullahi Yusuf of being behind the murder of Suldan Ahmed Mohamud Mohamed (Hurre). Like Amina Warsame, they did not produce any evidence for their allegation. That Suldaan Hurre was killed by the security forces of Puntland is acknowledged by the authorities of Puntland State. Neither the person(s) who killed him nor the motives for killing have yet been identified.

The Somali Peace Rally alleged that a criminal proceeding is now in progress in the UK against Abdullahi Yusuf for the murder of Suldan Hurre. If Somali Peace Rally was an organisation (or individual) that was interested in peace and justice for all, they would have checked the story. This story was originally propagated by some known individuals in London. The truth is that there is no criminal proceeding against Col. Abdullahi Yusuf in the UK. Col. Abdullahi Yusuf’s political opponents have done everything they could to smear his name without producing any shred of evidence. Abdullahi Yusuf was handed a writ for claims when he was in London for medical examination. Some individuals wrote to the court claiming compensation from Cabdullahi Yusuf. The court in turn wrote to Abdullahi Yusuf ordering him to reply whether he owed these people the money they were claiming.

The widely published case against Abdullahi Yusuf was for a compensations claim resulting from a crime and not a criminal proceeding. In the Queen’s Bench Division of the High Court in London, Ahmed Hurre’s former wife Zahra Abdullahi and her four children made a claim of £50,000 (fifty thousand pounds) against Abdullahi Yusuf in compensation for the murder by Puntland security of her husband, the late Suldan Hurre. I was told that the case was a straight forward case of claims and was not different from the hundreds of similar claims that are made every year in the courts.

Abdullahi Yusuf’s opponents would stop at nothing to portray him as a criminal who is awaiting trial in a foreign country, while the truth is that he is not awaiting any trial anywhere. The intention of the allegation is clear in the heading of the article by Somali Peace Rally. It is a gross distortion of the truth and a travesty of justice.

It would be advisable for Somali Peace Rally and other Somali organisations and individuals to desist from publishing defamatory information against Abdullahi Yusuf for which they have no evidence. If they have evidence, they should present it to the legal authorities of the country of their choice and the due process of the law will be followed. It is against the Sharia. It is also a disgrace to smear someone’s reputation unfairly. Like anybody else Abdullahi Yusuf also deserves justice. Those who are opposed to Abdullahi Yusuf should either take their cases to courts of law with their evidences or stop slandering him.

Crime investigation and service of justice are the function of institutions. It is not for anyone to make allegations against anyone else without proof. Islam has prohibits that one is accused of something for which there is no evidence. So do laws of many countries.

It is important that justice is sought for Abdirahman Aideed and Suldan Ahmed Hurre. It is equally important that in doing so, injustice is not committed against Abdullahi Yusuf and Mohamed Habib Warsame.
